1. Payment methods
The following payment methods are currently available in the Store:
- Bank transfer — payment is made after receiving the invoice, by transferring the amount to the Seller's bank account.
- Cash payment — payment at the moment the goods are received, agreed with the Seller in advance.
As a rule, the goods are handed over or delivered after the payment has been received, unless the Parties have agreed otherwise.
2. Product availability and order confirmation
Availability information is based on current warehouse data. If the ordered item is not available in the Seller's warehouse, the delivery time is agreed individually.
If the delivery time or availability changes, the Seller contacts the Buyer in order to agree on fulfilment or to offer an alternative solution.
3. Delivery
3.1. Delivery in Riga
Delivery within the territory of the city of Riga is carried out by the Seller's own delivery service.
- If the order is placed by 17:00 and the item is available in the warehouse, delivery is usually made on the same day.
- If the item is not immediately available in the warehouse, the delivery time is agreed separately and may range from a few days up to two weeks (depending on the supplier's warehouse and logistics lead times).
3.2. Delivery in the Riga region
Delivery in the Riga region (outside the administrative city limits) is usually carried out:
- on the next day, or
- no later than within 2 business days,
provided that the item is available in the warehouse and there are no other objective restrictions.
3.3. Delivery to other cities in Latvia
Delivery outside Riga and the Riga region is arranged individually, in agreement with each Buyer.
- The delivery price is determined depending on the distance and the complexity of the delivery.
- The delivery time is usually 5–7 business days (unless agreed otherwise).
3.4. Delivery costs
Delivery costs are not included in the price of the goods unless stated otherwise, and they are agreed and shown before the order is confirmed.
4. Additional services
Delivery, carrying the goods up to the premises, installation, connection, assembly and other additional work may be offered as separate services.
- If an additional service has been fully provided with the Buyer's prior consent, the fee for that service is generally not refunded if the Buyer later exercises the right of withdrawal in respect of the goods (to the extent provided for by law).
5. Prepayment, reservation and goods ordered on request
In certain cases (for example, rare models, an order placed with the supplier, a reservation) the Seller may request a prepayment (advance) of 10–100%. The specific amount is agreed with the Buyer individually.
- If the item is a standard product (not personalised and not made to the Buyer's specifications), the right of withdrawal after receiving the goods remains in force in accordance with the law, and the prepayment forms part of the amount paid.
- If the item is made to the Buyer's specifications or is clearly personalised, the right of withdrawal may not apply (exceptions to the right of withdrawal).
- If the Buyer cancels the order before the Seller has ordered or reserved the item from the supplier or has started fulfilment, the prepayment is generally refunded. If the order is cancelled after the Seller has already incurred justified costs (for example, supplier commissions, logistics costs), the Seller may withhold a proportionate amount to cover those costs, informing the Buyer accordingly.
6. Right of withdrawal, returns and refunds
A consumer has the right to withdraw from a distance contract within 14 days without giving a reason. The detailed procedure is described on the page: Product returns, right of withdrawal and refunds.
6.1. Notice of withdrawal and the form
To exercise the right of withdrawal, the Buyer submits a written notice (in free form or using the form). Sample withdrawal form: download the withdrawal form (DOCX).
6.2. Deadline for returning the goods and the cost of return
- After sending the notice of withdrawal, the Buyer must return the goods within 14 days.
- The Seller is entitled to withhold the refund until the goods have been received or until the Buyer provides proof of return (whichever occurs earlier).
- The direct costs of return are borne by the Buyer, except where the goods are non-conforming (defective or not as described).
6.3. Refund of delivery costs in the event of withdrawal
- In the event of withdrawal, the Seller refunds the amount paid by the Buyer, including delivery costs. However, if the Buyer has chosen a delivery method that is more expensive than the cheapest/standard delivery method offered by the Seller, only the standard delivery costs are refunded.
- Fees for additional services (carrying the goods up, installation and similar) are generally not refunded if the service was provided with the Buyer's consent (see section 4).
6.4. Inspection of the goods and diminished value
The Buyer may inspect the goods only to the extent that would be possible in a physical store (for example, examining them, switching them on, checking the basic functions), but may not use them over an extended period.
The Buyer is liable for any diminished value of the goods if the goods have been used more than is necessary to establish their nature, characteristics and functioning. The reduction is determined proportionately and supported by evidence (for example, photos or video, a service report), taking into account: the reduction in resale value, restoration of the packaging, cleaning or other necessary restoration costs.
6.5. Partial return of an order
If only part of an order is returned, the refund is made for the returned part of the goods. If the delivery fee was fixed and mandatory, it may be refunded proportionately in accordance with the applicable regulations and the circumstances of the specific order.
6.6. Refund deadline
The refund is made no later than within 14 days from the day on which the Seller received the information about the Buyer's decision to withdraw; however, the Seller may withhold the refund until the goods are received or proof of return is provided.
The refund is made using the same means of payment that was used for the purchase, unless the Parties have agreed otherwise.
7. Non-conforming goods, warranty and service
If the goods are damaged or do not conform to the contract, the Buyer submits a claim in writing to 1store@mercurius.lv, preferably attaching photos or video. Where necessary, the goods may be submitted to an authorised service centre for inspection.
In the event of hidden defects or non-conformity, the claim must be submitted immediately upon discovery.
8. Force majeure
The Seller is not liable for delivery delays or for failure to perform its obligations due to force majeure circumstances, for example, disruptions at suppliers or in logistics.
9. Dispute resolution
Disputes are first resolved through negotiation. If no agreement can be reached, the Consumer may turn to the Consumer Rights Protection Centre (PTAC) or, in the case of a cross-border purchase, contact the European Consumer Information Centre (ECC Latvia).
