These terms set out how circumstances of force majeure are applied and how risks are allocated between the online store 1store.lv, operated by Mercurius Trade SIA (hereinafter — the Seller), and the person placing an order (hereinafter — the Buyer).
1. Related documents and applicability

Where a document contains provisions specific to a particular situation (e.g. warranty, returns, delivery), the respective specialised document and the applicable laws take precedence.
2. Definitions
Consumer (B2C) — a natural person purchasing goods for purposes unrelated to economic or professional activity.
Legal entity / business customer (B2B) — a legal entity or a person purchasing goods for the needs of economic or professional activity.

3. What is force majeure
Force majeure means external, unforeseeable events beyond the Seller’s control that could not have been foreseen, prevented or overcome by reasonable means, including (but not limited to):
- natural disasters (floods, storms, fires, etc.);
- war, military conflicts, unrest, terrorist threats;
- epidemics/pandemics, quarantine or restrictive measures;
- orders, prohibitions and sanctions of public authorities, import/export restrictions;
- disruptions of electricity supply, communications, internet or payment systems;
- supply chain interruptions, strikes, customs delays;
- material disruptions in the operations of third parties (suppliers, manufacturers, couriers);
- cyberattacks, IT infrastructure failures, security incidents.
4. Consequences: performance of obligations and deadlines
- In the event of force majeure, the Seller is not liable for delays in delivery deadlines and delays in fulfilling the order.
- The performance of obligations may be suspended for the duration of the force majeure.
- The Seller resumes the performance of obligations within a reasonable time after the circumstances have ended, taking into account the actual logistics and supply chain.
5. Notification
Where possible, the Seller informs the Buyer of the occurrence of force majeure and its expected impact on the fulfilment of the order, by e-mail, phone or information on the website.
6. Transfer of risk and the Buyer’s obligations
- The risk of damage to or loss of the goods passes to the Buyer at the moment of delivery or collection of the goods (depending on the chosen method of receipt).
- The Buyer must provide correct contact information and a correct delivery address. Risks and additional costs arising from incorrect data are borne by the Buyer.
- On receiving the goods, the Buyer is advised to check the visual condition of the packaging at the moment of delivery (see the Delivery and Payment Terms).
7. Third-party risks
The Seller is not liable for disruptions in the operations of third parties (couriers, suppliers, payment systems, hosting or IT service providers) where these are beyond the Seller’s control. The Seller provides reasonable assistance with communication and finding a solution.
8. Cancellation and refunds in force majeure situations
If, due to force majeure, the fulfilment of the order becomes objectively impossible or is significantly delayed, the Parties may agree on cancelling the order or an alternative solution (a replacement, a change of the delivery deadline, etc.).
Refunds, returns and the right of withdrawal are applied in accordance with: the Product Returns Terms and the Delivery and Payment Terms.
9. Dispute resolution
Disputes are resolved through negotiations. If no agreement can be reached, the procedure described in the section Complaints Handling and Dispute Resolution applies.
