1. General information
These Warranty Terms set out the procedure for handling claims regarding the non-conformity of goods with the contract, manufacturer warranty (commercial guarantee) cases and the related processes in the online store 1store.lv, operated by Mercurius Trade SIA (hereinafter — the Seller).

2. Important: Consumer (B2C) and legal entity (B2B)
2.1. For consumers (natural persons buying for private needs)
If the Buyer is a consumer (a natural person purchasing goods for purposes unrelated to economic or professional activity), they have the consumer rights established by the applicable laws, including the right to claim non-conformity of the goods with the contract and to request that the problem be remedied, a replacement, a price reduction or termination of the contract, depending on the situation.
2.2. For legal entities / purchases for business use
If the goods are purchased by a legal entity or for use in economic/professional activity (B2B), the special consumer protection rules may not apply. In such cases the terms of the contract apply, as well as the manufacturer’s commercial guarantee terms (where provided).
Important: some manufacturers may limit or not apply the commercial guarantee if the product is used intensively or commercially (for example, in a hotel, rental property, etc.). The exact terms are always stated in the manufacturer’s warranty card, user manual or on the manufacturer’s website.
3. Types of warranty
3.1. Manufacturer warranty (commercial guarantee)
A manufacturer warranty is a voluntary additional commitment by the manufacturer or seller (commercial guarantee) that may provide a specific warranty period and service procedure. Commercial guarantee terms may differ depending on the brand and product type.
3.2. Non-conformity of the goods with the contract (rights against the Seller)
If the goods do not conform to the contract (e.g. the product does not match the description, has a manufacturing defect or does not meet quality requirements), the Buyer may submit a claim to the Seller in accordance with the applicable laws.
4. What is usually covered and what is not
4.1. Usually covered
- manufacturing defects and non-conformity with the contract not caused by the Buyer’s actions;
- functional failures under normal use, where this complies with the manufacturer’s warranty terms;
- failures whose cause is confirmed by an authorised service centre’s diagnostics as a warranty case.
4.2. The warranty usually does not cover
- mechanical damage (scratches, cracks, impact marks), liquid damage, ingress of foreign objects;
- damage caused by improper installation, connection, use or maintenance (incl. incorrect voltage, power surges);
- natural wear and consumables (e.g. filters, brushes, seals, batteries/accumulators, etc., where so specified by the manufacturer);
- damage after unauthorised interference, damaged seals/stickers, unauthorised repairs;
- cases where the product has been used contrary to its intended purpose or in unsuitable conditions.
The exact list of exclusions may differ — it is determined by the warranty terms of the specific product’s manufacturer.
5. How to submit a warranty claim

5.1. What to include in the claim
- the order number or invoice number;
- the product name, model and serial number (if applicable);
- a description of the problem (when it appeared, how it manifests itself);
- photo/video materials (if possible);
- the preferred solution (diagnostics/service, repair, replacement, etc.).
6. Diagnostics, service and costs
The product may be handed over to the manufacturer’s authorised service centre for diagnostics or repair. The decision on a warranty case is usually made on the basis of the service centre’s opinion.
- If the service centre confirms a manufacturing defect / warranty case — the costs of repair or replacement of parts are covered in accordance with the warranty terms.
- If it is established that the damage was caused by the Buyer’s fault or the warranty does not apply — the Buyer may have to cover the diagnostics, repair and/or transport costs according to the price list of the service/service provider (the Buyer is informed before the work begins).
7. Transport to the service centre
The transport arrangements (delivering the product to the service centre, arranging a courier, delivery back) are agreed individually. For large items (e.g. a refrigerator or washing machine), separate logistics arrangements may apply.

9. Dispute resolution
Disputes are resolved through negotiations. If no agreement is reached, the consumer has the right to turn to the Consumer Rights Protection Centre (PTAC) or to use the EU Online Dispute Resolution platform (ODR).
